Terms of Use

These Terms of Use ("Terms") govern your use of the TopoKit application ("the App"), developed by Nikolay Senilov. By downloading or using the App, you agree to these Terms.

License

TopoKit is licensed, not sold. Upon purchase, you receive a non-exclusive, non-transferable license to use the App on Apple devices you own or control, subject to the Apple Media Services Terms and Conditions and these Terms.

Intellectual Property

The App, including its name, design, code, and documentation, is the intellectual property of Nikolay Senilov. These Terms do not grant you any rights to use the TopoKit name, logo, or branding except as part of normal use of the App.

Intended Use

TopoKit is a field GIS tool designed for geographic data collection, visualization, and navigation. The App is provided as a general-purpose tool and is not certified for safety-critical applications.

Do not rely on TopoKit as your sole means of navigation in hazardous or remote environments. Always carry appropriate backup navigation equipment (paper maps, compass, dedicated GPS device) when working in the field.

Accuracy Disclaimer

While TopoKit strives for accuracy, geographic data — including coordinate positions, elevation values, map tiles, and routing directions — is provided on an "as is" basis. Accuracy depends on many factors outside the App's control, including GPS hardware, satellite geometry, environmental conditions, and the quality of underlying third-party data sources.

Elevation data is sourced from the Copernicus GLO-30 Digital Elevation Model and has a horizontal resolution of approximately 30 metres. This data should not be used as a substitute for professional survey-grade measurements.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NIKOLAY SENILOV DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Third-Party Services

The App relies on Apple MapKit for map tiles and routing, and on the Copernicus GLO-30 DEM for elevation data. These services are provided by third parties and may be subject to their own terms, availability, and limitations. Nikolay Senilov is not responsible for interruptions, changes, or discontinuation of third-party services.

The App also supports user-configured WMS and XYZ tile layer sources. If you add a custom tile layer, you are responsible for ensuring your use of that service complies with its terms. Nikolay Senilov has no control over and assumes no responsibility for user-configured third-party services.

Your Data

You own all data you create in TopoKit. The App does not claim any rights over your content. You are responsible for maintaining backups of your data. While iCloud sync is available, it is provided through Apple's infrastructure and subject to Apple's terms.

Limitation of Liability

To the maximum extent permitted by applicable law, Nikolay Senilov shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to damages resulting from inaccurate data, navigation errors, data loss, or reliance on the App in hazardous conditions.

Updates

The App may be updated from time to time to add features, fix bugs, or maintain compatibility. Updates are distributed through the Apple App Store. Continued use of the App after an update constitutes acceptance of any revised Terms.

Governing Law

These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict of law principles.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Changes to These Terms

These Terms may be revised at any time. The updated version will be posted on this page with a new "Last updated" date. Material changes will be noted in the App's release notes.
