Terms of Use

These Terms of Use ("Terms") govern your use of the TopoKit application ("the App"), developed by Nikolay Senilov. By downloading or using the App, you agree to these Terms.

Licence

TopoKit is licensed, not sold. Downloading the App gives you a non-exclusive, non-transferable licence to use it on Apple devices you own or control, subject to the Apple Media Services Terms and Conditions and these Terms.

Intellectual property

The App, including its name, design, code, and documentation, is the intellectual property of Nikolay Senilov. These Terms do not grant you any rights to use the TopoKit name, logo, or branding except as part of normal use of the App.

The free download and the full app

TopoKit is a free download. Without unlocking, you can open, view and export everything you made, search the map, read the GPS tab on iPhone, change Settings and sync through iCloud. Creating and editing need the full app, unlocked by Monthly, a subscription with a free first month, or by Unlock Forever, a single payment. Either unlocks every iPhone and Mac signed into the same Apple Account.

Anyone whose Apple Account got TopoKit before 1 January 2027, by buying it before it became a free download or by downloading it free before then, owns the full app on every iPhone and Mac signed into that Apple Account, with nothing to buy. The whole of 31 December 2026 counts, in every time zone. TopoKit reads this from the App Store's record of when your Apple Account first got the app.

Purchases, subscriptions and refunds are handled by Apple through the App Store under Apple's terms. You cancel Monthly, or the free month, in your Apple Account's subscription settings, which Manage Subscription in TopoKit opens. The free month costs nothing if you cancel before it ends. When a plan ends, everything you made stays on your device to view and export.

Intended use

TopoKit is a tool for viewing, collecting and navigating with geographic data. It is not certified for navigation, aviation, marine, vehicle or life-safety use of any kind.

Do not rely on TopoKit as your only way to navigate in remote or hazardous places. Carry another way to navigate, such as a paper map and compass or a dedicated GPS receiver.

Accuracy

Every position, elevation, map, route and measurement the App shows can be wrong. GPS reception, satellite geometry, weather, terrain and the data underneath all affect them. Geographic data, including coordinates, elevation, map imagery, basemaps and directions, is provided on an "as is" basis.

Elevation comes from the Copernicus GLO-30 elevation model, in which each value covers about 30 metres of ground. It is not survey grade and is no substitute for a survey.

Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NIKOLAY SENILOV DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Third-party services

The App relies on Apple Maps for the map, search and directions, on the App Store for purchases, and on Copernicus GLO-30 elevation data and Overture Maps map data, read from public copies on Amazon Web Services, for the elevation it shows and the basemaps it builds. These services are provided by third parties and may be subject to their own terms, availability, and limitations. Nikolay Senilov is not responsible for interruptions, changes, or discontinuation of third-party services.

The App also streams any tile or WMS server you add. If you add one, you are responsible for ensuring your use of that service complies with its terms. Nikolay Senilov has no control over and assumes no responsibility for services you add.

Your data

You own all data you create in TopoKit. The App does not claim any rights over your content. You are responsible for maintaining backups of your data. While iCloud sync is available, it is provided through Apple's infrastructure and subject to Apple's terms.

Limitation of liability

To the maximum extent permitted by applicable law, Nikolay Senilov shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to damages resulting from inaccurate data, navigation errors, data loss, or reliance on the App in hazardous conditions.

Updates

The App may be updated from time to time to add features, fix bugs, or maintain compatibility. Updates are distributed through the Apple App Store. Continued use of the App after an update constitutes acceptance of any revised Terms.

Governing law

These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict of law principles.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Changes to these Terms

These Terms may be revised at any time. The updated version will be posted on this page with a new "Last updated" date. Material changes will be noted in the App's release notes.
